“Red Flag” Gun Removal Orders

As a result of the shooting at Isla Vista in 2014, where the gunman’s family tried to have his firearms removed before he became violent but could not do so under the then-existing laws, California and many other states have passed “Red Flag” laws. Called Gun Violence Restraining Orders in California, these allow for the removal of guns from the possession of a person the Court finds to be a danger to themselves or others. However, because of the way the laws were drafted, they are rife with the potential for abuse.
